The Division of Utilities and Solid Waste Management, through responsible management of the county’s water, wastewater and solid waste infrastructure, strives to provide the community with a safe and dependable water supply and reliable waste disposal services that do not reduce or inhibit the use of the county’s natural resources.

The division provides for the planning, construction, and operation of the county’s water supply, wastewater disposal and solid waste pollution control infrastructure. These responsibilities and/or activities are distributed among six departments within the division and one support office.

 Public Improvement Agreements (PIA) for Water and Sewer Projects

As part of the BOCC Strategic Plan, GOAL #2, Predictability for Businesses, Frederick County will implement strategies to improve predictability for the business community in order to reduce inefficiencies, control costs, enhance process effectiveness, and increase understanding in daily business practices within Frederick County Government. Frederick County’s business processes must be clearly defined to the community. In certain areas, Frederick County will work to implement measurable, repeatable, and predictable business processes. Objective 7: By January 2012, work to simplify the installation of water and sewer infrastructure by developers. Evaluate the need to revise water and sewer public works agreements as a viable option versus having a contract between the county and developer’s contractor.

On May 19, 2011, the BOCC approved a pilot program involving the use of Public Improvement Agreements (PIA) for the installation of public water and sewer infrastructure, which included the option for third party inspection, as a possible alternative for constructing developer-funded water and sewer infrastructure. This Pilot PIA allowed developers to have the improvements installed using contractors and inspectors that report directly to the developer with limited County oversight.  On August 25, 2011, the BOCC approved Resolution No. 11-23, which temporarily suspended certain provisions of the Water and Sewer Rules and Regulations that were inconsistent with the PIA process.  On April 26, 2012, staff presented an update to the BOCC of the Pilot PIA program.  Finally, on October 11, 2012, following the last update regarding the pilot program, the BOCC approved continuing the PIA and directed staff to prepare a Resolution to make revisions to the Rules and Regulations in connection with the PIA option.  The PIA provides for "third party inspection" to construct developer-funded water and sewer infrastructure.

The BOCC approved Resolution 13-05 "Revisions to the Frederick County Water and Sewer Rules and Regulations to Implement the Public Improvements Agreement Option (Superseding and Replacing Resolution No. 11-23)," and was effective March 14, 2013.
